Significant exposure to litigation pursuant to subdivision (b) of Section 54956.9
Number of potential cases: Two (2)
FACTS AND CIRCUMSTANCES EXISTING RESULTING IN SIGNIFICANT EXPOSURE TO LITIGATION: On October 16, 2006, the Coronado Historic Resource Commission adopted its Resolution No. 43-06, granting an Historic Alteration Permit for the alteration of a structure located at 941 J Avenue, and the demolition and reconstruction of a structure located at 937 J Avenue. Both 937 and 941 J Avenue are located on the same lot or combined lots. At least four (4) owners of properties within 300 feet of 937-941 J Avenue allege that they never received notice of the public hearings conducted by the Historic Resource Commission, prior to adopting HRC Resolution No. 43-06, and have objected to the reconstruction of the structure located at 937 J Avenue. The City has issued a temporary stop notice for the construction of the new improvements at 937 J Avenue, until it can be determined whether the work can proceed without further Historic Resource Commission review, or without the right to an appeal of the decision to the City Council. The owner of the property located at 937-941 J Avenue, and property owners within 300 feet of 937-941 J Avenue who allege that they did not receive notice of the various hearings will be affected by a decision to either delay the work permitted by the Historic Resource Commission, or to allow the work to proceed without any further review by either the Commission or the City Council.
